Welcome to Best Jamaican Experience. By accessing our website or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully.
1. General Terms
Best Jamaican Experience ("we," "us," or "our") operates from Portland, Jamaica. These terms apply to all services we offer including:
- Tourism and tour services
- Digital solutions (website development, marketing, etc.)
- Event planning and management
- Photography and design services
- Educational workshops and training
2. Booking and Reservations
2.1 Tour Bookings
All tour bookings require advance reservation. Availability is subject to confirmation.
- Deposit Required: 50% deposit to secure booking
- Full Payment: Balance due 7 days before tour date
- Confirmation: Booking confirmed only upon receipt of deposit
- Group Sizes: Minimum group sizes may apply
2.2 Digital Services
Website development and digital services require:
- 50% deposit to begin work
- Signed service agreement
- Clear project specifications
- Final payment before launch/delivery
3. Cancellation and Refund Policy
3.1 Tour Cancellations
By Customer:
- 7+ days before tour: Full refund
- 3-7 days before tour: 50% refund
- Less than 48 hours: No refund
3.2 Digital Services Cancellations
- Before work begins: Full refund minus 10% processing fee
- After work begins: Deposit non-refundable, unused portion refunded
- After 50% completion: No refund available
3.3 Force Majeure
Tours cancelled due to weather, natural disasters, or government restrictions will be rescheduled or fully refunded at customer's choice.
4. Pricing and Payment
4.1 Currency
Prices quoted in Jamaican Dollars (JMD) or US Dollars (USD). Exchange rate at time of booking applies.
4.2 Payment Methods
- Bank transfer (NCB, Scotiabank, JMMB)
- PayPal
- Credit/Debit cards
- Cash (in-person only)
4.3 Payment Plans
Available for digital services over J$200,000 (USD $1,280). Terms must be agreed upon in writing.
5. Customer Responsibilities
5.1 For Tours
- Arrive at pickup location on time
- Provide accurate contact information
- Disclose medical conditions or allergies
- Follow guide instructions for safety
- Respect local culture and customs
- Bring required items (sunscreen, water, proper footwear)
5.2 For Digital Services
- Provide content, images, and materials on time
- Give clear feedback within agreed timeframes
- Review deliverables and approve milestones
- Pay invoices on schedule
6. Our Responsibilities
We commit to:
- Professional, courteous service
- Safe, well-maintained vehicles and equipment
- Experienced, knowledgeable guides
- Timely delivery of services
- Quality work meeting agreed specifications
- Clear communication throughout
7. Liability and Insurance
7.1 Tour Liability
While we maintain insurance and prioritize safety, customers participate in tours at their own risk. We are not liable for:
- Personal injury due to customer negligence
- Loss or damage to personal belongings
- Delays due to factors beyond our control
- Acts of nature or third parties
7.2 Travel Insurance
We strongly recommend customers purchase travel insurance covering medical emergencies, trip cancellation, and personal belongings.
7.3 Digital Services Liability
For websites and digital products, we are liable for:
- Work meeting agreed specifications
- Technical functionality as described
- Bug fixes within warranty period (typically 30 days)
We are NOT liable for:
- Hosting or third-party service failures
- Content provided by client
- Changes made by client after delivery
- Lost profits or business opportunities
8. Intellectual Property
8.1 Client Ownership
Upon full payment, clients own:
- Final delivered websites and code
- Custom designs and logos created for them
- Photography commissioned for their use
8.2 Our Ownership
We retain rights to:
- Portfolio use of completed work
- Template code and frameworks
- General methodologies and processes
9. Privacy and Data Protection
Your privacy is important. See our Privacy Policy for details on how we collect, use, and protect your personal information.
10. Photography and Media
During tours and events, we may take photos and videos for marketing purposes. By booking with us, you consent to:
- Photography during your experience
- Use of images on our website and social media
- Testimonial use (with permission)
If you prefer not to be photographed, please inform us at booking.
11. Changes to Services
We reserve the right to:
- Modify tour itineraries for safety or weather
- Substitute similar attractions if necessary
- Update pricing with 30 days notice
- Change terms and conditions (updates posted online)
12. Age Requirements
- Tours: Minors must be accompanied by adult
- Adventure activities: Age restrictions apply
- Alcohol service: 18+ years only (Jamaica legal age)
13. Health and Safety
13.1 Medical Conditions
Customers must disclose:
- Heart conditions, pregnancy, or mobility issues
- Allergies (food, medication, environmental)
- Any condition affecting participation
13.2 COVID-19 and Health Protocols
We follow Jamaican government health guidelines. Customers must:
- Stay home if feeling unwell
- Follow any current health protocols
- Respect health and safety measures
14. Complaints and Disputes
14.1 Complaint Process
If unsatisfied:

- We'll respond within 48 hours
- We'll work to resolve fairly
14.2 Dispute Resolution
Disputes will be resolved through:
- Good-faith negotiation
- Mediation if necessary

15. Governing Law
These terms are governed by the laws of Jamaica. Any legal proceedings must be conducted in Portland, Jamaica courts.
16. Severability
If any provision is found invalid, the remainder of these terms remains in effect.
17. Entire Agreement
These terms, along with any signed service agreements, constitute the entire agreement between customer and Best Jamaican Experience.
